Article 6 — Counter UAS for the Private Sector: What Is Useful, Lawful, and Realistic in High-Risk Environments

Counter-UAS is a rapidly evolving field that has generated significant vendor activity and considerable confusion about what private-sector actors can lawfully and practically deploy. This article examines what is actually useful, what is legally permissible, and what realistic success looks like for corporate security programs.
Start with the Core Misconception
The core misconception in private-sector counter-UAS discussions is that the goal is to defeat hostile drones. It is not. The goal is to protect the principal and the organization from the consequences of hostile drone activity. Defeating a drone is illegal for private-sector actors in most jurisdictions without specific government authorization.
The practical counter-UAS toolkit for most private-sector organizations is therefore limited to detection, warning, and protective procedure. Detection and warning, combined with well-designed protective procedures, can substantially reduce the risk that hostile drone activity will produce actionable intelligence or enable a successful attack.

The Four Layers of a Realistic Counter-UAS Program
Layer one is detection and warning: the ability to identify the presence of a drone and alert the security team. Layer two is protective procedure: the set of actions the security team takes in response to a drone detection. Layer three is decision and response protocols: the command-and-control framework that determines who has authority to initiate counter-UAS procedures. Layer four is technical options and their constraints: the limited set of active countermeasures that may be available with specific government authorization.
What Realistic Success Looks Like
Realistic success in private-sector counter-UAS is the consistent execution of detection, warning, and protective procedure that makes the principal a less attractive and less accessible target. An adversary who knows that a principal's security program includes reliable drone detection and a practiced protective response will seek a less well-defended target or a different attack vector.
